Can a doctors office withhold Temporary Disability Insurance forms because a balance is owed?
Yes, they can withhold your records if they say they are compiling your records for a lawsuit against you to sue you for non-payment.
HIPAA does allow health care providers to withhold certain types of medical records, including:
•psychotherapy notes
•information the provider is gathering and compiling for lawsuits, and
•medical information that the provider believes could reasonably endanger your life, your physical safety, or the safety of another person.

thank you for the info. this was not the office records, only the temporary disability forms since the patient was out of work and trying to get TDI during the treatment period. we did get them just now, but only after patient advocacy got involved from the state. There is no lawsuit involved in this.
